 H&S@W etc Act 1974 places general duties on both employers and the self-employed regarding employees. It also seeks to protect anyone else who may be affected by work activity such as visitors and members of the general public. (That is the 'etc' bit of the H&S@W etc Act).

The Act introduced a broad goals, rather than specific actionsl, based on the view that ‘those that create risk are best placed to manage it’. The Act is based on a philosophy of managers and workers working together to deal with concerns. In place of existing detailed and prescriptive industry regulations, it created a flexible system whereby regulations express goals and principles, and are supported by codes of practice and guidance, based on consultation and engagement.

The main duties on employers cover plant and systems, handling storage and transport of articles and substances, provide information, instruction, training and supervision, safe access and exit, working environment and welfare. Every employer must consult with any employee representatives about safety arrangements. They also have duties towards neighbours and to others who are not their employees - such as visitors.

Employees have a duty to "take reasonable care" towards other staff and to cooperate with complying with relevant legal provisions (e.g. Wearing designated PPE when spraying pesticides)
