What you should look for when screening your Labour Providers: contd.

H&S training/Hygiene records

  • If you have agreed that your LP will do any part of your H&S and/or hygiene training and checks, check that these meet your required standard and that all records have been signed by the workers.
  • H&S training can incled a generic understanding of H&S, site specific information eg where the fire exits are located, who the first aiders are and how to perform their job safely.
  • You may want to talk to workers to ascertain their level of understanding of the instructions given.

Contracts of employment

  • Workers should have a contract of employment which clearly describes the terms and conditions of the worker including their entitlement to holiday and sick pay.
  • Provision should be made to ensure this is understood by the worker, especially if English is not their first language.

Wages

  • Ensure that workers are being paid a tleast the national minimum wage. You can do this by talking to workers and asking workers to show you their payslips or asking the LP to show you samples of payslips of their workforce. You can also look at payroll system to check this reflects what you see in the payslips.
  • Identify if there are any deductions (other than tax and national insurance) being taken from workers wages eg transport, accomodation, loan. If there are you need to ask:
  • Are deductions accurate, fair and resonable?
  • Have workers given their written permission for this deduction to be made? If workers have not signed for the deeductions to be made and it take sthem below the minimum wage, it becomes an illegal deduction.
  • Any loan agreements should be fair and transparent and have the workers agreement.
