Working Hours - UK Law

Hours:

  • The standard working week is 48 hours averaged over a 17 week period. For agricultural workers this is reduced to 8 hours per day, 39 hours per week.
  • Minors are not permitted to work nights.
  • Pregnant and breast feeding women have the option of not working nights if it is a risk to the child or mother.

Time-off:

  • Workers who have been employed for more than 13 weeks are entitled to 4 weeks paid leave per year (rate of pay determined in the contract).
  • At least one day off in 7 or 2 days off in every 14 day period.
  • A worker should have 11 hours rest between each shift.
  • After 6 hours wor, the worker is entitled to 20 minutes rest.
  • Young workers (16-18) are entitled to a 30min break after 4.5 hours of work and 2 days off per week.
  • Women are entitled to 26 paid maternity leave, and 1 year in total away from their jobs. Men are entitled to 1 or 2 weeks paid paternity leave, depending on length of employment and earnings, all of which must be taken after the birth.
  • Parents are entitled to up to 18 weeks unpaid parental leave. This allowance must be taken before the child's 5th birthday.
  • Women are entitled to paid time off during pregnancy for antenatal visits.

Agricultural workers are entitled to:
- 22 days plus public holidays where they work a 5 day week, if they work longer or shorter periods, this is adjusted on a pro rata basis.
- 3 days full pay following the death of a dependant

Overtime:
- Minors are not permitted to work overtime
- Over 18s cannot work overtime unless they have signed an opt-out agreement with their employer.
- Agricultual workers who work more than 8 hours per day and/or 39 hrs per week, work on a Sunday or on a public holiday are entitled to appropriate agricultural overtime rates.
