Regular Employment - Law

Very limited legal provision for regular employment in Kenya.

This means that:

  • If an employer dismisses a worker it must be for a valid and legal reason. They must give the legal period of notice and pay the worker the remuneration and severance pay that they are due.
  • All workers should have a contract of employment which includes their terms of employment, working hours and pay (for standard hours and overtime hours).
  • All workers should receive the social security benefits to which they are legally entitled, whether they are contract workers, temporary or permanent labour.
  • Employers should not exploit workers through the use of repeated temporary contracts.
  • Employers using contract labour must follow the regulations of the law as above.
