General

What you should look for when screening your Labour Providers: contd.

Hours

  • Look at hours records to make sure that workers are not working more than 48 hours per week without signing an opt out agreement. If they have signed an opt out agreement, ensure they are not working excessively long hours and they get 2 days off in every 14.
  • Remember that workers may work at different sites in any time period. You may need to look at timesheets for multiple Labour Users.

Accomodation

  • If your LP provides accomodation for their workers, you should make a physical inspection of this where possible. If you do so check to see if it is hygienic and safe and that it is not overcrowded. It is a good idea to take photographs so you have evidence of what you saw.
  • Check tenancy agreements to make sure the accomodation provision does not bond the workers to their employer.

Transport

  • If your LPs provide transport for their workers, you should make a visual inspection fo the vehicles when they are on your site eg look at tyre tread, tax discs and if seat belts are provided.
  • You should also see and keep copies of drivers licenses and service records. If workers are charged for transport, the vehicle should have a PSV licence. This is demonstrated by a blue disc which is displayed in the vehicle window.
  • When looking at licences bear in mind the ability of the driver to understand written English as they need to be able to understand road signs.
